New York court rules viewing child pornography online not a crime

In a controversial decision that is already sparking debate around the country, the New York Court of Appeals ruled on Tuesday that viewing child pornography onlineis not a crime.

“The purposeful viewing of child pornography on the internet is now legal in New York,” Senior Judge Carmen Beauchamp Ciparick wrote in a majority decision for the court.

The decision came after Marist College professor James D. Kent was sentenced to prison in August 2009 after more than 100 images of child pornography were found on his computer’s cache.

Whenever someone views an image online, a copy of the image’s data is saved in the computer’s memory cache.

The ruling attempts to distinguish between individuals who see an image of child pornography online versus those who actively download and store such images, MSNBC reports. And in this case, it was ruled that a computer’s image cache is not the same as actively choosing to download and save an image.

“Merely viewing Web images of child pornography does not, absent other proof, constitute either possession or procurement within the meaning of our Penal Law,” Ciparick wrote in the decision.

The court said it must be up to the legislature, not the courts, to determine what the appropriate response should be to those viewing images of child pornography without actually storing them. Currently, New York’s legislature has no laws deeming such action criminal.

As The Atlantic Wire notes, under current New York law, “it is illegal to create, possess, distribute, promote or facilitate child pornography.” But that leaves out one critical distinction, as Judge Ciparick stated in the court’s decision. 

“[S]ome affirmative act is required (printing, saving, downloading, etc.) to show that defendant in fact exercised dominion and control over the images that were on his screen,” Ciparick wrote. “To hold otherwise, would extend the reach of (state law) to conduct—viewing—that our Legislature has not deemed criminal.”

The case originated when Kent brought his computer in to be checked for viruses, complaining that it was running slowly. He has subsequently denied downloading the images himself.

Former South African president FW de Klerk has sparked outrage after he gave a television interview in which he appeared to justify elements of apartheid.

The Nobel Peace Prize laureate, 76, faced widespread condemnation this morning after he told the American news network CNN he believed there was merit in the idea of different ethnic groups living apart.

Mr De Klerk told CNN that the idea of ethnic communities being separated, as under apartheid, was ‘not repugnant’.

He added that black people were not deprived of power under the apartheid regime, saying: ‘They were not disenfranchised, they voted’

The former president served as South Africa’s last white leader before the advent of democracy in 1994, and served as deputy president under Nelson Mandela until 1996.

He was asked by CNN reporter Christiane Amanpour whether he believed apartheid had been morally repugnant.

He answered: ‘In as much as it trampled human rights it was and remains morally indefensible.

‘I have made the most profound apology in front of the Truth Commission and on other occasions about the injustices which were wrought by apartheid.’

But he added: ‘What I haven’t apologised for is the original concept of seeking to bring justice to all South Africans through the concept of nation states.

‘In South Africa it failed. By the end of the 70s we had to realise, and accept and admit to ourselves that it had failed. And that is when fundamental reform started.’

Mr De Klerk made his remarks as he spoke to CNN in Chicago, where he has been attending a summit of Nobel laureates.

The statesman was awarded the peace prize jointly with Nelson Mandela in 1993 after the pair negotiated a peaceful end to apartheid.

Mr De Klerk’s National Party had previously controlled a white minority government in South Africa from 1948 to 1994.

The party brought in a series of draconian laws which formalised a system of apartheid in which racial groups were forced to live apart.

By the late 1950s the apartheid government had developed its policy to include the creation of ‘homelands’ for the black population.

The supposedly-autonomous states, which received little international recognition, comprised less than 15 per cent of South Africa’s land but were designed to house around 80 percent of its people.

The policy was greeted with mass protest by the country’s majority black population, who were denied the vote and forced to obtain permits to visit or work in white areas.

In his interview with CNN Mr De Klerk said he had initially believed in the concept of apartheid.

He said: ‘There is this picture that apartheid used to be compared to Nazism.

‘It’s wrong, and on that, I don’t apologise for saying that what drove me as a young man, before I decided we need to embrace a new vision, was a quest to bring justice for black South Africans in a way which would not – that’s what I believed then – destroy the justice to which my people were entitled.’

He added: ‘That’s how I was brought up. And it was in an era when also in America and elsewhere, and across the continent of Africa, there was still not this realisation that we are trampling upon the human rights of people. So I’m a convert.’

When he was asked a second time whether he believed the policy had been morally wrong, he said: ‘I can only say in a qualified way.

‘Inasmuch as it trampled human right, it was – and remains – and that I’ve said also publicly, morally reprehensible.

‘But the concept of giving as the Czechs have it and the Slovaks have it, of saying that ethnic unities with one culture, with one language, can be happy and can fulfil their democratic aspirations in an own state, that is not repugnant.

‘They were not put in homelands, the homelands were historically there. At that stage the goal was separate but equal, but separate but equal failed.’

Mr De Klerk’s comments today sparked a wave of outrage in South Africa.
The former president was the top trending term on Twitter as thousands posted remarks condemning his views.

Many called for the retired statesman to return his Nobel peace prize in light of his apparent unwillingness to accept apartheid was wrong.

One tweeter, Nqubi, wrote: ‘You see what forgiveness gets you.’

Journalist Victor Dlamini added: ‘I suppose De Klerk played a role in ‘ending’ Apartheid in the same way a hostage taker plays a role in “releasing” his hostage.’

Another person wrote on Twitter: ‘FW de Klerk remains a bitter apartheid apologist and defender. Can’t say I am shocked.’

Thabo Mekwa added: ‘Oh de Klerk what have you done. Now you’re helping create a new breed of young racists who were born in a democracy. 2 steps back for all.’

Mr De Klerk stepped down from public life following Mr Mandela’s election as president in 1994.

The former statesman now lives in Cape Town and conducts work through the FW De Klerk Foundation.

His spokesman Dave Stewart today said the retired statesman had not intended to cause offence.

He said: ‘What he was trying to say was that the Union of South Africa was an artificial creation.

‘If you have an artificial creation you can go two ways – either by going your separate ways like in the Soviet Union or in what is being suggested for Israel and Palestine, or by trying to build a multicultural society.

‘Mr De Klerk was saying that as a young man they tried to go for the first option in South Africa.

‘They changed course when they realised it was not working.’

He added: ‘It is not immoral for the Afrikaners to want to rule themselves any more than it is for the Israelis or the Scots to wish for the same things.

‘Mr De Klerk meant no offence by his comments and the response is unjustified.

‘It is a nonsense to suggest he should return his peace prize.

‘In fact South Africa is now a constitutional democracy whose citizens have rights which were created through the negotiations that he himself set in motion.’

Seller of Trayvon Martin Gun Range Targets Says They Sold Out in Two Days

“My main motivation was to make money off the controversy,” said the seller of a gun range target designed to resemble murdered Florida teen Trayvon Martin in an email to Local 6 reporter Mike DeForest.

The seller remains unidentified despite the correspondence.

The Orlando-based news station says it spotted an ad for the targets — since removed — on a “popular firearms auction website.” They feature a black hoodie similar to the one worn by Martin on the night he was shot by self-appointed neighborhood watch captain George Zimmerman, along with a drawing of a Skittles bag and a can of iced tea.

The seller is reportedly a supporter of Zimmerman who believes “he is innocent and that he shot a thug.”

Zimmerman’s lawyer, Mark O’Mara, rejected the support, calling the targets “the highest level of disgust and the lowest level of civility.” He expressed concern that “this type of hatred” is “going to make it more difficult to try this case.”

According to the seller, others are much more keen on the item. Though they would not say how many $8 ten-packs were produced, they claim the response has been “overwhelming,” and the targets “sold out in 2 days.”

white female arrested for leaving 10-month-old and 6-year-old alone in car while tanning

A mother in Pennsylvania left her infant son and young daughter alone in her car while she went tanning at a local salon.

Krista Mann, 28, now faces child endangerment charges and a wrath of public scrutiny as her incident comes on the heels of New Jersey mom Patricia Krentcil earning the moniker ‘tanning mom’.

Krentcil was charged with allegedly bringing her pale red-head daughter into a tanning booth with her and has since been banned from 63 tanning salons in her home state.

CBS News reports that Krentcil’s ban happened on the same day as news of Mann’s arrest broke.

Though Krentcil is significantly more tan than Mann, the similarities between the cases will certainly raise the heat that both mothers are facing.

A neighbor of Mann’s told local ABC affiliate WHTM that she is a good mother but simply under stress.

‘It’s a mistake and I know she’s devastated,’ Trish Rowles told the station.

The incident occurred when a police officer saw the 6-year-old girl and her 10-month-old brother sitting in a car in Elizabethtown, Pennsylvania unattended.

The officer, who was doing meter checks on Saturday morning, asked the girl where their parents were and she pointed to the tanning salon nearby.

One credit that Mann does get: she told her daughter never to talk to strangers, so when the police officer was asking questions she would only point her answer and began to cry.

Mann was in the tanning booth when the officer arrived at the salon, and she told him that it was ‘stupid’ of her to have left her children in the car.

She said she had forgotten her driver’s license, and when it was presented, the officer learned that it had been suspended because of a prior arrest for drunken driving.

As a result, she now faces two charges of child endangerment, two charges of leaving a child in an unattended vehicle, and a charge of driving on a suspended license.

If convicted of the last charge, she will face at least the mandatory minimum sentence of 60 days in jail.

‘The thing that we hope occurs is that we raise public awareness to the fact that we should not be leaving our children unattended in vehicles, particularly with the keys in the ignition,’ police chief Jack Mentzer told The Huffington Post.

Investigation: The Internet Crimes Against Children Unit (ICAC) searched the home of NBA player Chris ‘Birdman’ Andersen in connection with child pornography

The Douglas County Internet Crimes Against Children Unit (ICAC) investigated the Larkspur, Colorado home of NBA player Chris ‘Birdman’ Andersen in connection with child pornography on Thursday.

The ICAC said they began investigating Andersen, 33, in February of this year, after they were given a tip from a law enforcement agency in California.

Pending the completion of the investigation, Andersen has been suspended from all team-related activities by the Denver Nuggets.

Sergeant Ron Hanavan told the Mail Online that the ICAC confiscated property from Andersen’s Red Hill Road estate that they believe is connected to a case.

The ICAC investigates crimes ranging from the exchange of pornographic images to child prostitution.

Sergeant Hanavan said that no arrests have been made at this time.

 ’We need to complete a thorough investigation to determine what, if any appropriate charges would be forwarded to the District Attorney for prosecution,’ Sergeant Hanavan said to the Mail Online.

The Denver Nuggets have cut ties with Andersen pending the results.

‘The Denver Nuggets are aware of today’s media reports involving forward/center Chris Andersen. It involves a legal investigation and we are awaiting further details,’ team officials wrote in an unsigned statement to the Denver Post.

This year marks Andersen’s 10th in the NBA and his seventh season in Denver.

The forward has a history of getting involved in children’s charities, according to the Daily News.

Andersen has raised money for Mount Saint Vincent, a sanctuary for abused children, and the Alliance for Choice in Education (ACE), which provides funding for low-income families to send their children to private schools.

Sergeant Hanavan told the Mail Online that Andersen has been cooperating.

His attorney, Mark Bryant, released a statement on his behalf.

Seed Planter: Greetings, Dr. Welsing I was watching the White Supremacy programming device commonly known as the tellievision. The program “Hip Hop and LA Riots” seemed like it was used as a tool to program and provoke certain behaviors in victims of racism, possibly resulting in an uprising, once Zimmerman walks. Did you notice this?

Dr. Welsing: Yes, this is exactly why black people must understand what the system is and how it works. We already know Zimmerman is going to walk. We know this. Why burn down the stores in our own neighborhoods? We should be saying to ourselves this is proof. Proof of the existence of the system of Racism/White Supremacy. No more denying it. It’s time to respect ourselves, and modify our current behaviors in order to produce a system of Justice.
