Jared Lee Loughner on Tuesday pleaded guilty to the 2011 mass shooting in Tucson, Ariz., that killed six people and wounded 13 others including former U.S. Representative Gabrielle Giffords. The guilty plea was part of an agreement that prevents him from facing the death penalty.

With defense attorney Judy Clarke at his side, Loughner, wearing a khaki jail uniform, calmly answered questions from U.S. District Court Judge Larry A. Burns, saying that he understood the court rules and that he would plead guilty to 19 of the counts against him, with the other 30 counts to be dropped. Asked if he understood each charge as they were read, Loughner simply replied, “Yes, sir.”

The verdict came on Tuesday after Burns was convinced that Loughner, 23, was competent to enter a plea and could understand the court proceedings, what he was accused of and the ramifications of his actions. The plea, following Loughner’s long-anticipated competency hearing, forgoes what was expected to be a lengthy trial that would have been draining on survivors and victims’ family members, many of whom attended the proceedings. While Loughner’s sentencing won’t be held until Nov. 15, he will likely spend the rest of his life behind bars, serving multiple life sentences with no possibility of parole.

In court, he admitted to murdering a federal employee, attempted murder and causing death at a federally protected activity. “There’s no question in my mind Loughner understands what’s going on today,” Burns told the court.

Loughner, who dropped out of a community college he attended for five years, has been held in a medical facility in Missouri since the shooting and was flown on Monday to Tucson to appear at the hearing. Experts have concluded that he suffers from schizophrenia, and they’ve kept him on psychotropic drugs for more than a year. The hearing, which began at 11 a.m. local time, started with testimony from Dr. Christina Pietz — a forensic psychologist who has been treating Loughner — who told the court that she felt Loughner was competent to stand trial. If he were sent to the general population in prison, she said, she has no concern that he would harm anyone else as long as he is given his medication.

“My concern is someone will harm him,” she said. Pietz also testified that Loughner has a rational understanding of the proceedings and that he knows he will never leave prison.

On Jan. 8, 2011, Loughner opened fire with a legally purchased semiautomatic pistol on a crowd gathered to hear Giffords speak at a “Congress on Your Corner” event in the parking lot of a Tucson supermarket. Before bystanders tackled and disarmed him, he managed to kill six people — among them U.S. District Judge John Roll and Giffords staffer Gabe Zimmerman — and wound 13 others, including Giffords, who suffered a serious brain injury. Loughner was later charged with 49 counts of murder and attempted murder. The shooting deaths of Roll and Zimmerman would have made him eligible for the death penalty, had he not entered the plea deal.

In a statement released on Tuesday, Giffords supported the plea deal. “The pain and loss caused by the events of Jan. 8, 2011, are incalculable,” Giffords said in a joint statement with her husband Mark Kelly. “Avoiding a trial will allow us — and we hope the whole southern Arizona community — to continue with our recovery.”

Hancock County bestiality trial continued

The bestiality trial of a LuVerne man has been continued.

The trial of Steven Schindler, 50, was to have started Wednesday in Hancock County District Court in Garner.

The trial has been continued to a future date. No new trial date has been set.

Schindler is facing one count of bestiality, an aggravated misdemeanor.

Schindler entered a written plea of not guilty in March.

According to the Hancock County Sheriff’s Department, Schindler, an employee of Farmers Cooperative Elevator of Ottosen, went to a rural Britt customer’s residence on Feb. 20 under the ruse of delivering propane and allegedly performed a sex act on the customer’s dog.

A husband and wife are accused of raping their 13-month-old daughter during what was supposed to be a supervised visit at a children’s service center, and recorded it on a cellphone – which also contained 532 images of child bestiality.

Felicia and Cody Beemer, from Trumbull County, Ohio, originally pleaded not guilty to the charges. But yesterday, Cody, 23, changed his plea to guilty on charges of rape, gross sexual imposition and four counts of pandering obscenity involving a minor.
It also emerged that he previously raped his 18-month-old nephew while they were babysitting him, which was also taped on the phone. He also pleaded guilty to that charge.

He was sentenced to life in prison with the possibility of parole in 25 years on the rape charge. All other sentences will run along with the most stringent sentence.

It was when an older relative found the SIM card with the footage on it that she turned it over to police.

When they investigated, as well as the footage of the children being raped, police also found 532 images of minors either involved in or watching a ‘montage of obscenity and bestiality’, the indictment states.

Judge Andrew Logan said: ‘This is one of the most outrageous and despicable acts that has ever come before this court. We’re talking about children of tender ages, newborns really abused in the most outrageous manner.’

Warren Law Director Greg Hicks said: ‘The child is and has been in the custody of Children Services and during a scheduled visitation they are alleged to have raped the child.

‘There are other allegations which we are investigating, that there may in fact be more charges on one or both of these individuals involving minors.’

The 13-month-old daughter was taken away from the couple as soon as she was born and there is currently an investigation underway as to how they were able to harm her during a supervised visit.

Children’s Services Board acknowledged they had relaxed the supervised visitation for the Beemers prior to the rape and caseworkers were checking in on them only in ‘timed intervals’ during the weekly two-hour-long visits, according to The Tribune Chronicle.

Questions are also being asked about why Cody Breemer was even allowed on the premises as he is a registered sex offender.

He sexually assaulted a three-year-old girl when he was a teenager, which CSB were aware of.

In the wake of this investigation, CSB executive director Nick Kerosky has resigned.

Felicia Beemer, 21, cried when she appeared in Warren County court.

She has had three other children removed from her care in the past, including one-and-a-half-year-old Tiffany Sue Banks, who was murdered by foster mother Bonnie Pattison.

Her trial is pending.

A black transgender Minneapolis woman pleaded guilty to second degree manslaughter in the stabbing death of a local man, but her supporters maintain she was the actual victim in the case.

As the Minneapolis Star-Tribune is reporting, 23-year-old CeCe McDonald is expected to be sentenced June 4 to three years and five months in prison for the death of Dean Schmitz, a white man.

McDonald was walking past a local bar on June 5, 2011 when an altercation between her and Schmitz, in addition to other patrons, erupted on the sidewalk outside. According to various reports, McDonald — who was transitioning at the time — said she pulled out a pair of scissors in an attempt to defend herself after the group hurled a glass at her face, and taunted her and her friends with both anti-gay and racist epithets, including “faggots,” “niggers” and “chicks with d*cks.”

Schmitz, who allegedly had a swastika tattoo and was between the ages of 41 and 47 according to varied reports, died at the scene from a stab wound to his chest.

Minneapolis City Council Member Cam Gordon is among those to defend McDonald, saying she was targeted for her race and gender. “It appears that CeCe was the victim of a hate crime that involved many people but she was the only person held by the police,” Gordon wrote on his blog. “Here is another example transgender women of color being targeted for hate- and bias-related violence. It is unfortunate that in this case, as in so many, the hate crime itself appears to have been ignored.”

Melanie Williams, columnist for the Minnesota Daily, felt similarly. “[Schmitz's] attack, therefore, was not just a random attack on one person’s body, but an attack on an entire race and entire gender,” she wrote. “An entire population of living, breathing, feeling people are hurting with McDonald, perhaps not physically but in the core of who they are.”

Though prosecuting attorney Mike Freeman has insisted that “gender, race, sexual orientation and class [were] not part of the decision-making process,” McDonald’s supporters have also drawn attention to the treatment she is said to have received from officers and other officials throughout the course of the investigation and trial. According to Support CeCe McDonald, a website created “in solidarity with trans people targetted [sic] by the prison industrial complex”:

CeCe was briefly taken to the hospital where she received 11 stitches in her cheek. Then, while she was still suffering both physically and mentally from this traumatic incident, she was left alone in a room for three hours and then interrogated, after which she was placed into solitary confinement. She spent the next several months in jail and had to wait almost two months between her initial doctors’ visit and a much-needed follow-up appointment.

During that time, her cheek swelled into an extremely painful, golfball-sized lump, making eating difficult and producing headaches and pressure on her left eye and ear. Ironically, the only gesture towards CeCe’s well-being that authorities made during her incarceration was to put her in solitary confinement “for her own protection” on two separate occasions, despite her stated desire to be housed alongside other prisoners.”

The second defendant in a Feb. 6, 2011, racially-motivated attack in downtown Brainerd will serve more than five years in prison for the crime.

Travis Arnold Campbell, 30, Pequot Lakes, was sentenced Thursday in Crow Wing County District Court to five years and nine months in prison by Judge Richard Zimmerman. Zimmerman said Campbell — wearing a faded blue jail uniform with his waist and hands in shackles — will be given credit for time served and a third of his sentence will be served on supervised probation, during which he is to have no contact with the victim, Willy Navy.

Campbell previously had pleaded guilty to severely beating Willy Navy, who suffered serious head injuries in the attack. Navy attended Thursday’s sentencing and said justice has been served.

Campbell and another defendant, Lucas Eastwood, 27, Backus, were charged with felony first-degree assault, felony third-degree assault, gross misdemeanor fourth-degree assault motivated by bias after attacking Navy after the three left a bar in downtown Brainerd in the early morning hours of Feb. 6, 2011. Eastwood was sentenced in October to eight years, and seven months in prison for his part in the crime.

“You (Campbell) have a lot of time to serve and I hope you take advantage of what they (prison) can offer you,” said Zimmerman. “I expect that Navy would hope that you will be a better man coming out of prison … I hope you realize that your stupid actions impacted Navy’s life and he didn’t even bother you and you changed his life.”

Before Zimmerman sentenced Campbell, new details of the case were presented, which resulted in Campbell pleading guilty to first-degree aggravated robbery. Campbell admitted to taking money from Navy’s pocket during the assault. Campbell also admitted that he had a folded pocket knife in his fist during the beating of Navy.

The judge asked Campbell several questions to make sure he understood the court procedures and what he was admitting to, such as he was not claiming his innocence and that he caused serious harm to Navy. Most of Campbell’s answers were either “yes sir” or “no sir.” When Zimmerman asked Campbell what he was pleading guilty to Campbell said: “I assaulted somebody and injured Willy Navy.”

Campbell answered “yes sir” when asked if he was entering his guilty plea on his own free-will, that he was thinking clearly and he was not being threatened to plead guilty.

When the judge asked Campbell if he wanted to say anything to Navy or the court, Campbell paused for a second and then said, “No sir.”

Before the sentencing, Navy gave a brief victim impact statement.

In a light tan-colored suit and black shoes, Navy addressed the court and said, “I wanted justice to be served and I wanted him to speak the truth and he told the truth … I got some justice on the case.”

Navy, 54, who suffered numerous facial injuries in the attack, said he’s had health problems since the attack and to make matters worst his mother had passed away. Navy said he suffers from severe headaches, is dealing with depression and he still has problems with his eyes.

Navy’s injuries after the attack included fractured bones around his eye and the injuries have caused dizziness, light-headedness, double vision, scarring to his left cornea, fluid leakage, light sensitivity, headaches and the inability for both eyes to track together.

After court, Navy, who no longer wears an eye patch, said that he can see good out of one of his eyes, but the other eye is still blurry, and he continues to have a lot of fluid leakage.

According to court documents, Campbell, Eastwood and other friends were at a downtown bar on Feb. 5, 2011, and Campbell didn’t know Navy, but had contact with him in the bar. Campbell clarified that there was a verbal argument with Navy in the bar.

Outside the bar, Campbell and Eastwood followed Navy toward South Eighth and Laurel streets, with Navy and Eastwood “verbally sparring” ahead of Campbell.

Eastwood and Campbell, who drank beer and smoked synthetic marijuana that night, punched Navy. In total, Campbell admitted to punching Navy about 20 times and kicking him about five times.

Navy suffered significant injuries and spent four days at Essentia Health St. Joseph’s Medical Center in Brainerd, including time in the intensive care unit.

Ga. Doctor Andrew Sutton Sentenced in Child Pornography Case

A Georgia doctor is heading to prison in a child pornography case.

A judge sentenced 48-year-old Andrew Sutton — an ear, nose and throat doctor from metro Atlanta — to eight years in prison Friday. Sutton had previously pleaded guilty to federal charges.

Authorities arrested Sutton last March on charges of possessing and distributing child pornography. Prosecutors say he had asked an undercover officer for nude photos of two children and later transmitted pornographic images of other children to the undercover investigator.

Police say they found other images of child pornography on computers seized from the doctor’s home.

Sutton’s attorneys argued he suffers from an addiction and should be sentenced to a treatment facility rather than prison.
